1-Sales terms and conditions

These General Conditions of Sale govern the terms of sale of art and handicrafts products made by Carraro Chabarik of Chabarik Mohamed in their workshop, from which they are shipped directly to the customer at the end of sale process, and services related to them (hereinafter also referred to as “products”) and regulate the contracts of sale of such products concluded in this web site between Carraro Chabarik di Chabarik Mohamed and the buyer (hereinafter also referred to as “the Customer”). These conditions of sale shall remain effective until changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website www.carrarochabarik.it and will refer to sales made from that moment on. The customer is required to read and accept the terms and conditions and any notices before the making of each purchase. These premises are an integral and essential part of every product sale agreement within www.carrarochabarik.it website.

2- On-line agreement

For “on-line purchase agreement” we mean the contract at a distance and the legal transaction concerning goods and / or services concluded between a Supplier, Carraro Chabarik di Chabarik Mohamed, and a Customer, as part of a distance sale system organized by the supplier, that for this contract employs mainly, but not exclusively, the remote communication technology called “Internet”. All contracts, therefore, will be concluded, unless otherwise agreed, through direct access by the consumer client to the corresponding website www.carrarochabarik.it where, following the procedures indicated, she/he will conclude the contract for the purchase of the product.

 

3-How to Buy

The languages ​​in which it is possible to carry out the purchase process are Italian and English.
The customer choose from www.carrarochabarik.it window the products that she/he wants to buy, after having read the descriptions and saw photos, and select them pressing “Add to cart” button. She/he goes on the Cart page . This will contain the selected products, with a summary of prices including taxes and the estimated costs. By clicking on the button “Proceed to checkout” the customer must enter her/his billing and shipping information. To place an order must also be accessible via telephone and e-mail address. The customer is responsible for the correct compilation of the data.
After entering the data, we will summarize again the unit costs of each product chosen (inclusive of VAT); you will be given the opportunity to choose the delivery method, if there is more than one possibility, with related expenses, calculated according to the actual shipping address; It will finally be shown the total cost of the order. The customer then chooses and selects a payment method among those listed on the page (see article 6) and will have to declare to have read and accepted these “Terms and Conditions of E-shop Carraro Chabarik”. At this point, using the “Place Order” or “Proceed with Paypal”, depending on the chosen payment method, the Customer confirms the order and pay. The customer will receive an e-mail message containing the receipt of the order with the relevant information and details and the order number, to be indicated in case of request for information. The purchase invoice will be sent to the customer with the products themselves.
At her/his discretion, the customer can choose to create an account on our website, with user name / email address and password: doing so she/he won’t re-enter all data in case of other purchases and may at any time consult her/his orders.

 

4-Product availability

The products are unique pieces and thus in most cases available in stock in the amount of only one piece (with the exception of the “Tesserae” series); therefore, although we are committed to do everything possible to reserve the intended e-commerce products and update in real time the situation of the stock, we may not be able to provide these products in extraordinary cases or for reasons beyond our will . In this case the customer will be contacted and notified as soon as possible, with a proposal (which she/he will be free to accept or not) of alternative products to replace. In case the Customer decides not to accept our proposals, the amount of the order relating to the products that we are not able to provide will be refunded by bank transfer (the data of which will be communicated by the Customer), with the issuance of a credit note.
The images of products selected and ordered on www.carrarochabarik.it site are photographic reproductions as close as possible to the real product, but compared to it may have slight differences in shading. Also remember that all products are hand-made art objects and their irregularities guarantees their authenticity and uniqueness.
We also remind you the existence of the legal warranty of conformity of products.

 

5-Delivery

Deliveries are made in the countries (in Italy and the European Union) that are recognized by the site at the time of the calculation of shipping costs. Shipping countries, times and costs are summarized below:

Above the 30 kg: free shipping (excluding any customs fees). The Customer will be contacted to agree on the best delivery method.

 

Generally, delivery will be executed as follows:

Delivery, made with Poste Italiane/SDA, will take place on weekdays, from Monday to Friday. For deliveries in Italy, in the absence of the Customer (or person authorized to withdraw: family component, partner, family helper, goalkeeper, and person involved in the distribution of mail in apartment blocks or buildings) at the time of delivery, a notification will be left to inform the recipient that it will automatically be made a second attempt to deliver, on the business day following the non-delivery. In case of failure to deliver even at the second attempt, it will be left with a notification containing the Post Office references where the recipient can pick up the shipment in the next 10 working days, including Saturdays, starting from the working day following the date of second delivery attempt.
For deliveries in Europe (in countries which are in the list of shipping destinations), there are one or two attempts of delivery, depending on the country; in case of absence of the recipient, a notification will be left with the indications of the office where the shipment will be in storage and the storage term.
In all shipment destinations (both Italy and Europe) it is Customer task to withdraw the shipment on time; after the storage terms the shipment will return to the sender-supplier, and the order amount paid will not be refunded.
Indicatively, without any obligation and out of circumstances beyond control, the goods will be delivered in Italy within 3 to 5 working days from Monday to Friday, depending on customer’s shipping method choice, when purchasing the product; within 6 working days from Monday to Friday in Europe.
The shipping costs are calculated according to weight and include insurance of the goods.
In the event that, in particular cases or voluminous items, Carraro Chabarik di Chabarik Mohamed chooses to use different delivery methods to those specifically mentioned, these will be communicated to the customer via e-mail. Problems and additional costs for custom duties or other will be agreed between Carraro Chabarik of Chabarik Mohamed and the Customer, who will have to authorize them (in case of foreign shipping, additional costs -beyond shipping costs- due to taxes or fees determined by the law of the country of destination will be charged to the Customer).

 

6-Methods of payment

For online purchases Carraro Chabarik of Chabarik Mohamed accepts the following payment methods:
6.1 – PAYPAL
6.2 – CREDIT CARDS THROUGH VIRTUALPAY
6.3 – BANK TRANSFER

In case of purchase through PayPal or Credit cards with Virtualpay, filling out the Website spaces for these methodes of payment, the Customer authorizes Carraro Chabarik of Chabarik Mohamed to use her/his credit card, or other card issued in replacement, to accredit to the account of Carraro Chabarik di Chabarik Mohamed the total amount indicated as the final cost online. Carraro Chabarik of Chabarik Mohamed, however, at no time during the purchase procedure is able to know the number of the credit card used, that is transmitted directly to the bank of the service provider, opening a secure connection, .
Carraro Chabarik of Chabarik Mohamed reserves the right to unilaterally modify at its sole discretion whether to enable new payment systems in the future or eliminate payment methods used before.

6.1 – PAYPAL

The procedure is done via secure connection. The Service is provided by PayPal (Europe) S.à r.l.et Cie, S.C.A. (“PayPal”) to registered users residing in the European Economic Area (EEA).
PayPal (Europe) S.à rl & Cie, S.C.A. (RCS Luxembourg B 118 349) is a Luxembourg credit institution duly licensed pursuant to Article 2 of the law of 5 April 1993 on the financial sector as amended (the “Law”) and is subject to prudential supervision Surveillance of Luxembourg, the Commission de Surveillance du Secteur Financier, with registered office in Luxembourg, owner and operator of online payment service, which Carraro Chabarik of Chabarik Mohamed can not access.

6.2 – CREDIT CARDS WITH VIRTUALPAY

The procedure is done through the VIRTUALpay service of Casse Rurali Trentine and Banche di Credito Cooperativo BCC, which provides a secure system for payments by credit card on the internet.
At the moment of payment, the site www.carrarochabarik.it redirects the client to the secure website of the bank that allows you to pay by credit card through VIRTUALpay. The details of the credit card data are entered only on the secure site VIRTUALpay and are never disclosed to Carraro Chabarik of Chabarik Mohamed. VIRTUALpay system will verify the correctness of the data on international authorization circuits.
The service is provided by Phoenix Informatica Bancaria SpA.
The recognized cards are those belonging to recognized and accepted circuits of Virtualpay platform. At the moment, cards  belonging to the Visa and Mastercardare accepted.
The goods will be sent exclusively after confirmation of acceptance of the transaction by the Virtualpay circuit.

6.3 – BANK TRANSFER

Payment is made by bank transfer. The amount will be indicated to the customer at the time of the order. The bank details to make the transfer are the following:

7-Responsibilities

Carraro Chabarik of Chabarik Mohamed does not assume any responsibility for problems due to circumstances beyond control and / or unforeseeable circumstances such as accidents, theft and / or robbery to the delivery service, fires, explosions, strikes and / or lockouts, earthquakes, floods and other events that could prevent, in whole or partially, to implement in the time and manner agreed to the contract. Carraro Chabarik of Chabarik Mohamed can’t be responsible for direct or indirect damages, losses and costs in general, suffered as a result of failure to execute the contract for the reasons mentioned above.
Carraro Chabarik of Chabarik Mohamed is not responsible for any fraudulent or illegal use that may be made by others of credit cards, checks and other means of payment, while buying the purchased products. Carraro Chabarik di Chabarik Mohamed, in fact, at no time during the purchase procedure is able to know the number of the credit card which, by opening a secure connection, is transmitted directly to the bank manager of the service; Carraro Chabarik di Chabarik Mohamed is also unable to monitor the authenticity of the identity proofs shown in the moment of delivery of goods.

 

8-Customer’s duties

The customer agrees, once the procedure of buying online is concluded, to print and preserve the present general conditions, which, however, she/he has already seen and accepted as a compulsory step, in the purchasing procedure.
It is strictly prohibited to enter false and / or invented identities and data in the registration process required to provide the procedure for the execution of this contract and the subsequent communications; personal data and e-mail must be the Customer’s real personal data and not of other people, or invented. It is expressly forbidden to make double entries corresponding to a single person or enter data of others. Carraro Chabarik of Chabarik Mohamed reserves the right to denounce any violation or abuse, for the protection of all consumers.

 

9-Right of withdrawal

If, for any reason, the Customer is not satisfied with the purchase, she/he can withdraw from the contract without any penalty, except for the expenses of shipment.
The withdrawal must be expressed within 14 days from the date of receiving of goods, by sending an explicit statement of its decision to terminate the contract, specifying all the details of the sale: Customer’s name, invoice number, order number; possibly using the model withdrawal form located below. Such notice should be sent, preferably by e-mail at info@carrarochabarik.it (fastest method), or by mail.
The Customer, within 14 days from the date on which she/he communicated to the sender/supplier her/his decision to withdraw from the contract, will have to return to the sender-supplier all purchased goods intact, free of scratches and stains, wrapped in their original packaging and with all the accessories present at the time of purchase, with nothing missing), accompanied from the original invoice, to the address:

The cost of returning will be charged to the customer and the means to be used are on customer’s responsibility.
Carraro Chabarik of Chabarik Mohamed will refund all payments received from the customer, excluding additional ones (that is, if the consumer has expressly opted for a more expensive delivery than the basic one offered), within 14 days from the day in which he’s’informed of the Customer’s decision to withdraw from the contract; if he has received the goods in return. Once the goods are received, Carraro Chabarik di Chabarik Mohamed will issue a credit note for the amount of your deposit as soon as possible, and refund the money using the same means of payment used by the customer for the initial transaction, or other agreed mode.
The right of withdrawal shall not be applied in the case of products not on the e-shop page of the site, and then made according to the customer, tailor-made for the same or clearly personalized.

11-Privacy

Personal data collected will be processed in accordance with art. 13 of Decree No. 196/2003 (Italian law) for contract purposes and the necessary communications. Personal data is collected with the purpose of registering the Customer and provide the execution of this contract, with the necessary communications; data is processed electronically in compliance with laws and can be produced only at the request of the judicial authority or other lawfully entitled authorities. 12-Jurisdiction

Any dispute regarding the application, execution, interpretation and violation of purchase contracts stipulated “on line” through the website www.carrarochabarik.it refers to Italian jurisdiction.
